Domestic violence and disorderly conduct charges dominated a short session of Batesville Municipal Court Wednesday.
Judge Bill McKenzie dismissed one of the domestic violence charges after hearing testimony from defendant Christopher Douglas and affiant Lisa Butler.
Butler’s complaint stemmed from an incident she alleged to have occurred Oct. 2 at a home the couple shared at 223 Boothe Street. The judge heard testimony first from Butler, who described the alleged abuse; then from Douglas, who denied her allegations.
Butler filed her complaint on Oct. 4.
“These cases are difficult when there is a lack of witnesses,” Judge McKenzie said after hearing the testimony and examining documents. “The court is not convinced beyond a reasonable doubt that an assault occurred,” the judge added, dismissing the charge.
Another domestic violence charge, this one against Anthony Aubrey, 128 Patton Lane, Batesville, was remanded to the files pending his completion of four days of counseling sessions. Court records identified Jacqueline Aubrey as the victim of the incident.
Michelle Taylor, 209 Eureka Street, entered a guilty plea in a third case of domestic violence. She paid a $402 fine.
An Indianola man was fined $1,160 after pleading guilty for a second offense driving under the influence (DUI) charge that included his refusal to take a field sobriety test and an improperly equipped vehicle. Larry Kirksey, 514 Whiteside, Indianola was given credit for five days served in jail and ordered to work ten days at the Batesville Convention Center to satisfy the balance of the fine.
Joel Covington, 119 Highway 51 South, Batesville was ordered to return to court in two weeks to face charges that include a first offense DUI with refusal to take the field sobriety test, driving while license suspended and careless driving, court records state.
Dejon Pryor, 6485 Kirby Parkway, Memphis, was the first of the three defendants who appeared in court on disorderly conduct — failure to comply charges. Pryor satisfied his $632 fine with the eight days served in jail before his court appearance.
A disorderly conduct — failure to comply charge against Ghiocel Civrar, 508 Q. St., Rio Landa, CA was remanded to the files and Civrar ordered released from jail where he had been lodged since his arrest.
James Taylor, 143 Patton Lane, pled guilty to disorderly conduct — failure to comply, failing to stop for an officer’s signal, reckless driving and running a stop sign. He was fined $885 after his attorney negotiated to have additional charges of no tag, no driver’s license and no proof of insurance dropped.
Christopher Hogue, 49 Red Bud, Oakland, entered a plea of guilty and paid a $333 fine for petit larceny. Judge McKenzie ordered Hogue to pay $350 restitution to CB Electronics whose owner, Bobby Morrow, was the affiant.
Kendarious Crump, no address given, pled guilty to possession of marijuana. He was fined $428 and ordered to work eight days for the city.
Lashundric O. Cosby, 309 Arizona, Batesville, charged with running a stop sign, pled guilty and paid a fine of $181.
Robert Lee Perry, 201 Bright St., Batesville, charged with expired tag and no proof of insurance, was fined $417 total, an amount that reflected consideration of his having provided proof of insurance at court.
