Judge hears testimony following fight at Moma Cats

Judge Bill McKenzie listened to a probable cause hearing before referring a man to the grand jury during Batesville Municipal Court held on Wednesday.

Detrailous Webster, 2585-A Chapeltown, Courtland, was charged with felony malicious mischief for alledgedly damaging affiant Iesha Draper’s 2005 Gold Infinity car.

The report said her car had $2,642 worth of damage done.

Draper said the incident stemmed from an altercation  that started at “Mama Cats”, a former convenience store located station across from the Junction and Love’s on Hwy. 35 N.

Witness Lorenzo Key testified he was driving the car when Webster knocked the window out of the car.

Witness Marquita Fletcher said she was behind the vehicle when the incident happened.

“I said something to him about hitting the car. I saw him hitting the car,” she said.

Webster testified he was nowhere around the car and he was trying to break up a fight.

“I was the security guard outside when girls were fighting. There were all kind of people outside,” said Webster.

The owner of the club, Romi Jaswil said when he went outside he saw someone with a baseball bat and Webster was trying to break up a fight, but he never saw a vehicle being damaged.

“I told them I was calling the police,” he said.

Another witness, Patrick Stigler said when he saw the defendant’s car stop, “they popped the trunk and got out with baseball bats.”

“There were so many people there,” Stigler said.

Judge McKenzie ruled there was probable cause to send the case to the grand jury.

Three defendants entered guilty pleas to selling alcohol to minors and were fined $300.

Officer Jimmy McCloud said they had been working on a sting to stop the stores from selling to minors.

Angela Dees, 170 Dees Rd., Enid, entered a guilty plea for selling alcohol to the female minor at Harry B’s.

Patricia Starkey, 1477 Pope Rd., Batesville, was reluctant to enter a guilty plea until McCloud told her he had video footage of the sale.

She then entered a guilty plea but told the judge before hearing about the footage, “I asked her for her i.d. and she gave me her birthday.”

Starkey sold the minor the alcohol from Kangaroo.

Amanda Steele, 108 Clinton, Batesville, entered a guilty plea to selling alcohol to a minor as she drove up to the drive thru window at Batesville Express.

The police report stated the 18 year-old female was wearing a body wire and video camera before entering the stores.

“She was told that if the clerk asked for identification she must show it and if they asked her age that she must be honest,” said McCloud.

The police report stated McCloud and other Special Agent Officers followed the minor into the stores.

The Alcohol Beverage Commission was notifed.

Lashanda Russell, 231 Patterson, Batesville, was referred to the grand jury for grand larceny.

Malcolm Arnold, 244 Dogwood, Batesville, had a trial set for domestic violence-simple assault (second offense).

Cases continued

James D. Johnson, 616 Providence Place, Senatobia, had a case continued for possession of alcohol by a minor and contributing to delinquency of a minor.

April Laughter, 613 Dandridge, Senatobia, had a possession of alcohol by a minor and contributing to delinquency of a minor continued.

Alan Price Jr., 613 Dandridge, Luxahoma, had possession of alcohol by a minor, contributing to the delinquency of a minor and open container charges continued.

John Gibson, 18705 Hwy. 315 West, Sardis, had a case continued for DUI-first, possession of alcohol by a minor and contributing to delinquency of a minor continued.

John McKie, 202 Calvary, Batesville, was fined $925 for DUI and careless driving.

Wendy Howard, 1339 Tocowa, Courtland, entered a not guilty plea to simple possession of controlled substance.

“I had a prescription,” she told the judge.

A trial was set for November 2.

Jermaine Jones, 4812 North 104th, Milwaukee, Wis., was fined $1,097 for possession of marijuana in a vehicle, loud music and no driver’s license.

Jasmarious Robinson, 302 Patton Lane, Batesville, had a case set for November 2 after entering a not guilty plea to possession of marijuana in a vehicle.

Maurice Wilkins, 107 MLK No. 23, Batesville, also entered a not guilty plea to possession of marijuana in a vehicle. A trial was set for November 2.

Martevious Robinson, 105 Browning, Batesville, entered a not guilty plea to possession of marijuana in a vehicle. All three Jasmarious, Maurice and Martevious were in the same vehicle where the marijuana was found in the console.

Dekeidrick Mister, 205 Jones, Batesville, was also in the vehicle and entered a guilty plea to having possession of marijuana in his pocket.
He also had old fines of $204 that have been due since July 2011.
He entered the city’s work program for 12 days to satisfy his fines.

Shoplifting

Latasha Wallace, 107 MLK, Batesville, entered a guilty plea to shoplifting from Piggly Wiggly. She was fined $1,124.

Ericka Barber, 708 Letha Wiley, Sardis, was fined $1,124 for shoplifting. She also had old fines of $691 that have been due since August 2010. She told the judge she paid the fines at the jail.

Judge McKenzie told her to return next week with proof she paid her fines.
Contempt

George Todd Jr., 330 Ford Rd., Batesville, had a malicious mischief case dismissed after the affiant, Allison Johnson failed to appear to prosecute.

Reginald Chapman, 107 Dickey Dr., Batesville, had old fines of $472 that have been due since June 2010.
The case was continued.

Veronica Heffner, 306 Percyville, Sardis, had old fines of $458 that have been due since November 2010. The judge told her to have the fines paid in full by October 28 or serve 90 days in jail.

Cases set for trial
Machele Reid, 201 Birch, Batesville, had a no driver’s license case heard in her absence.
She was found guilty in her absence after the police officer gave testimony and fined $295.
She also had old fines of $885 that have been due since May 2011.

Rhonda Jarrett, 164-A Anthony Rd., Pope, was fined for an expired tag.

Fredrick Cosby, 211 Vance St., Batesville, had a simple assault case dismissed after a short trial.

Iesha Griffin, 425 Greenbriar, Courtland, had a malicious mischief case dismissed.

Tickets
Kellie R. Baker, Skyline Motel No. 133, Batesville, was fined $572 for expired tag and driving while license suspended.

Shaneke L. Burdette, 114 Lawson, Batesville, was fined $784 for speeding, no proof of insurance and no seat belt.

Willie J. Diggs, 102 Lawson, Batesville, was fined $436 for speeding and no driver’s license.
