City Court Report

A stalking case ended with a restraining order for both the affiant and the defendant after Judge Bill McKenzie heard testimony from both sides during Batesville Municipal Court Wednesday.

Erica Box of 123 File Rd., Batesville, filed stalking charges against Erika Nelson of 643-B Hudson Rd., Sardis.

When Judge McKenzie asked Box why Nelson might not like her she said, "She has two children with my boyfriend Keith Wooten." Box also has a child with Wooten.

Box told Judge McKenzie that Nelson had sent 17 text messages on her cell phone and one voice message threatening her.

Judge McKenzie looked at the text messages and listened to the voice messages.

After hearing both testimonies, Judge McKenzie gave both Box and Nelson a court order to stay at least 250 feet away from each other and to not call each other.

"Somebody is going to jail if this doesn’t stop," said Judge McKenzie.

Shoplifting
Mark Pearson of 508 Maryann Cove, Oxford, had a felony shoplifting case continued for a week.

Brenda Crocker and Jesse Lee Crocker of 9640 CR 211, Oakland, were fined $610 for taking a pair of shoes worth $9.87 from Wal-Mart. They were also banned from the premises.

Brenda Crocker told Judge McKenzie, "The shoes were on my grandson’s feet, I just forgot to pay for them."

Jesse James Crocker of 9640 CR 211, Oakland, was fined $610 for taking a CD player and four CDs worth $70.09 from Wal-Mart. He was also banned from the premises.

Disorderly conduct
Xazavagion Jones of 478 Teasdale, Enid, entered a guilty plea to being in a fight at South Panola High School.

"I just let my emotions get the best of me," said Jones.

He was fined $265.

Domestic violence
Thomas Watkins of 217 Pearson St., Batesville, entered a guilty plea to striking his grandmother in the face and stomach. He was sentenced to five days in jail, which he had already served.

Other
Galon Shorter of 701 S. Pocahontas, Sardis, failed to appear for charges of DUI (refusal), no proof of insurance and old fines of $344 that have been duce since April of 1998. His total fines are $1,653.

Teresa Brooks of 203 Deaton St., Batesville, entered a guilty plea to possession of marijuana less than an ounce and contempt of court-old fines of $765 that have been due since June of 2005. She had previously been ordered to pay the fine in two equal payments as of July of 2005, but never did.

"We aren’t gong to keep begging you to do what you are supposed to do," said Judge McKenzie.

Brooks was ordered to pay total fines of $1,120 or do 90 days in jail.

James Sullivan of King St., Batesville, had a DUI (second), careless driving and driving while license suspended case continued.

Contempt of court
Bobby Johnson of 522 Gleaton Rd., Pope, failed to appear for contempt of court-old fines of $459 that have been due since June of 2005.

Kemp Blackmon of 226 Noble St., Batesville, was sentenced to 90 days in jail for contempt of court-old fines of $867 that have been due since December of 2004. He couldn’t work the fine off because he had previously failed to finish the work program.

The city’s work release program is an option for defendants who cannot pay their fines.

Calandra Flowers of 111 Cole Dr., Batesville, was ordered to pay old fines of $455 that have been due since August of 2004.

Flowers must pay before October 21 or she will serve 90 days in jail.

Carl E. Fondren of 109 Normandy, Batesville, was also ordered to pay old fines of $425 before October 21 or serve 90 days in jail.

Alexander Gates of 119 1/2 Field St., Batesville, enrolled in the city’s work release program for 41 days for old fines of $1,654 that have been due since July of 2004. He is currently incarcerated at the Sheriff’s Department for other charges and will start work as soon as he is released.

Sherman Burgess of 2766 Seven Rd., Batesville, entered a guilty plea to disorderly conduct-failure to comply, running a stop sign, reckless driving, no driver’s license, expired tag and failure to yield to blue lights. He also had a no proof of insurance fine lowered after providing proof.  His total fine was $1,721.

Latasha Harris of 3671 Bethlehem Rd., Batesville, had a simple assault charge dismissed after the affiant Jerry McBrayer failed to appear to prosecute.
She also had old fines of $254 due since December of 2004. She was ordered to have it paid by the end of the month or serve 30 days in jail.

Tickets
Annette M. Ellis of 409 Armstrong St., Batesville, was fined $356 for driving while license suspended.
D’Marius A. McMillan of 225 Noble St., Batesville, entered a not guilty plea to switched tag. A trial date was set.

James Mosley of 445 Sardis Rd., Sardis, was fined $356 for driving while license suspended and a reduced fine of $184 for expired tag.

Harold McFarley of 1106 Tidwell Rd., Batesville, had a no proof of insurance charge dismissed after he provided valid proof.

Derrick Carr of 128 Patton Lane, Batesville, was fined $583 for no proof of insurance.

Tonya Milam of 143 Milam Rd., Batesville, had a lower fine of $183 imposed after proving proof of insurance.

Stephanie Frost of 2559-A Hentz Rd., Courtland, entered a not guilty plea to speeding. A trial date was set.
