Woman’s loud objections bring disorderly conduct charge

A woman was found guilty by Judge Jay Westfaul for simple-disorderly conduct-failure to comply after testimony during Batesville Municipal Court held Wednesday.

Officer Jon Horton testified he was on a call looking for a subject who ran from officers through Elizabeth LeMaire’s yard on 210 Van Voris, Batesville.

Horton said when he apprehended the subject and patted him down, LeMaire started screaming.
“She said we (officers) had no right to be in her yard or to pat the subject down. I asked her to quieten down, but she kept cussing and refused,” said Horton.

Horton said Officer Clyde Estridge was also on the scene.

“She refused to stop yelling after requests from me, Estridge and mostly her mother,” Horton said.

LeMaire testified loudly, “He searched them on my co-workers vehicle! All I asked is how he can search on the back of someone’s car and I didn’t get loud til he came in my yard. My yard is private property!”

LeMaire and her mother both admitted she was told several times to go inside and be quiet.
“No one read me my rights and I should of had a female officer,” she added when speaking of her arrest.

“I think you watch too much TV. You don’t know the law as much as you think you do. No female officer is required to make an arrest,” Westfaul stated as he ruled.

The original charge was disorderly conduct-failure to comply.

“I think it would be appropriate to reduce the charges to simple disorderly conduct-failure to comply,” he said.

Her fine was $315 instead of $632.
Belmon J. Smith, 203 Fisher St., Batesville, bonded out prior to court for felony malicious mischief and was referred to the grand jury.

A new TV has been installed in the courtroom for evidence purposes, making it easier for the judge and court to view surveillance videos and recordings from police traffic stops.
The television was donated by Walmart.

Alfonzo Tucker, 1832 E Woodruff Rd., Batesville, had a warrant issued for his arrest after failing to appear to answer an open container charge.

Hannah E. Simmerman, 135 Public Square, Batesville, entered a not guilty plea to charges of simple assault and willful trespassing. A trial was set for September 25.

Robert Williams, 150 MLK, Batesville, had a charge for domestic violence-simple assault dismissed after the affiant, Keasia Hall, failed to appear to prosecute.

Nelia Segars, 138 Hemlock, Batesville was found guilty of running a stop sign during a case set for trial.

Tickets
Gena C. Tarver, 7420 Dummyline Rd., Batesville, was fined $163 for speeding.

Latoya D. Dailey, 2161 Curtis Locke Station, Batesville, was fined $407 for reckless driving and running a stop sign.

Brandon T. Pittman, 179 Linker St., Pope, was fined $205 for no proof of insurance. The lower fine was imposed after he proved he purchased insurance after the ticket was issued.
